    Court sets court date for Oracle SAP lawsuit

Case management meeting results in giving vendors their day in court, two years after filing initial complaint.

Oracle and SAP will finally get their day in court to hear the lawsuit accusing SAP of fraudulent access to support materials, almost two years after Oracle filed the original complaint.

The presiding judge set a date of 9 February 2009 for the trial to begin with four weeks set aside for proceedings, during a case management conference held late yesterday to discuss details of the ongoing discovery phase of the suit.

The Northern District Court in San Francisco also set a deadline for motions of 13 November 2007, before a further case management conference, which has been scheduled to take place 12 February 2008.

SAP said in a statement that the court is also likely to issue a more detailed order setting limits on the scope and schedule of discovery and examine the possible use of mediation to reach an early settlement in the dispute.

SAP had called for an early resolution to the case in papers filed with the court last month, having admitted to discovering some "inappropriate downloads". But Oracle dismissed the call, accusing SAP of trying to "make this case go away".

Oracle's lawsuit alleges that SAP US support subsidiary, TomorrowNow used logins "stolen" from high profile Oracle customers, to fraudulently access and download information for competitive advantage from Oracle's support website.

Oracle had made no comment on the events at time of writing.
